Stride Terms of Service
Effective date: 26 August 2026
Legal-review note: this is a complete working draft and must be reviewed and signed off by a qualified South African attorney before publication. The only real-world detail not embedded here is the registered entity's official particulars (name, registration number, postal address), which cannot be invented and must be confirmed by you.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of Stride, the website at https://stride-edu.co.za, and the related learning application (together, the "Service"), provided by Stride ("Stride", "we", "us"), operated by its founding team. By creating an account, giving consent for a child, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Who may use Stride
- Learners under 18 may use Stride only after a parent or legal guardian has completed the consent process and agreed to these Terms on their behalf.
- Parents and guardians are responsible for the account and activity of the child in their care and confirm they are the competent person entitled to consent to the processing of the child's personal information.
- Adults (including university learners, teachers, and lecturers) may use Stride on their own behalf.
3. What Stride does, and what it does not promise
Stride helps a learner find the underlying gaps in their understanding and rebuild them through short, guided practice and review. Stride is an educational support tool. It is not a substitute for a school, a teacher, or professional educational, medical, or psychological advice or assessment. We do not guarantee any particular exam result, mark, or outcome. Learning depends on many factors, including a learner's own effort. You use the Service, and rely on any information or result it provides, at your own risk, and any decision you make based on it is your own responsibility.
4. Accounts and security
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for keeping sign-in details confidential and for activity that happens under the account.
- Tell us promptly at info@stride-edu.co.za if you believe an account has been used without permission.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in breach of these Terms.
- Attempt to access data that is not yours, or to circumvent the security or access controls of the Service.
- Interfere with, disrupt, or place undue load on the Service.
- Copy, scrape, resell, or commercially exploit the Service or its content without our written permission.
- Upload harmful, abusive, or unlawful content.
We may suspend or end access that breaches these rules.
6. Content and intellectual property
- The Service, including its software, design, curriculum structure, and verified teaching content, is owned by Stride or its licensors and is protected by law.
- We grant you a personal, limited, non-transferable, revocable licence to use the Service for its intended educational purpose.
- Content produced about a learner (such as their progress) belongs to the learner and their guardian for their own use; we process it as described in the Privacy Policy.
7. Beta program
If you take part in the Stride beta:
- The Service is provided in a pre-release state and may change, break, or be interrupted.
- We collect data during the pilot as described at sign-up and in the Privacy Policy, to improve the Service.
- Any reward offered for participation (for example a period of free access after the pilot) is described at sign-up and provided at our discretion in line with what was communicated.
8. Fees
Access during early access and the beta is free unless stated otherwise. If we introduce paid features in future, we will make the price and terms clear before you are charged.
9. Privacy
Your use of Stride is also governed by our Privacy Policy, which explains how we handle personal information, including children's information under POPIA. By using the Service you acknowledge that policy.
10. Availability and changes
We aim to keep Stride available and reliable, but we do not guarantee uninterrupted access. We may add, change, suspend, or remove features, and we may update these Terms. If we make a material change we will update the effective date and, where appropriate, notify you. Continued use after a change means you accept the updated Terms.
11. Third-party links and services
The Service may link to or rely on third-party websites and services. We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk and subject to their terms.
12. Disclaimers and limitation of liability
Provided as is. To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quality, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, free of harmful components, or that it will produce any particular educational result.
Educational tool only. You acknowledge that Stride is a learning-support tool, that it is not professional educational, medical, or psychological advice, and that any use of, or reliance on, the Service and its results is at your own risk.
No indirect loss. To the maximum extent permitted by law, neither Stride nor its founders, employees, contractors, or suppliers are liable for any indirect, incidental, special, consequential, exemplary, or punitive loss, or for any loss of data, profit, opportunity, savings, reputation, or goodwill, arising from or connected with the Service or these Terms, whether in contract, delict (including negligence), or otherwise, even if advised of the possibility.
Cap on liability. To the maximum extent permitted by law, our total aggregate liability to you for all claims connected with the Service is limited to the greater of the amount (if any) you paid us for the Service in the 12 months before the event giving rise to the claim, or ZAR 1,000.
Time limit for claims. To the extent permitted by law, any claim connected with the Service must be brought within six (6) months after the event giving rise to it, failing which you waive it.
What we do not exclude. Nothing in these Terms excludes or limits any liability that may not lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any right you have under the Consumer Protection Act that cannot be waived. Where such law applies, the limitations above apply only to the fullest extent that law permits.
13. Indemnity
To the maximum extent permitted by law, you indemnify and hold harmless Stride, its founders, employees, contractors, and suppliers from and against any claim, demand, action, liability, damage, penalty, loss, and reasonable cost (including reasonable legal costs) arising from or connected with your use or misuse of the Service, your breach of these Terms, your violation of any law, or your infringement of the rights of any person, except to the extent the loss was directly caused by our own unlawful conduct.
14. Ending use
You may stop using Stride at any time, and a parent or guardian may withdraw consent and close a child's account. We may suspend or end access if these Terms are breached or if required to protect learners or the Service. On closure we handle personal information as set out in the Privacy Policy. The clauses that by their nature should survive termination (including intellectual property, limitation of liability, and indemnity) continue to apply.
15. Dispute resolution
If a dispute arises, we ask that you first contact us at info@stride-edu.co.za so we can try to resolve it directly. If it cannot be resolved that way, the parties will attempt in good faith to resolve it through mediation before taking the matter to court. Nothing in this clause prevents either party from seeking urgent relief from a court where necessary.
16. Notices
We give notices to you by email or through the Service. You give notices to us by email to info@stride-edu.co.za. A notice is treated as received when sent, unless the sender is aware it failed to deliver.
17. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Stride about the Service and replace any earlier understanding.
- Severability. If any provision is found unenforceable, the rest remain in force and the unenforceable part is applied to the smallest extent necessary.
- No waiver. If we do not enforce a right immediately, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of the Stride business, and your rights are not reduced by doing so.
- Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.
18. Governing law
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction, without affecting any mandatory consumer rights you have where you live.
